WHAT IS ARTICLE 370?

article 370, what is article 370
Article 370

Recently Indian government revoked Article 370, which gave special state status to Jammu and Kashmir.

I know you all already heard about that on news and social media. But, the question is, what is article 370? When it introduced?  Blah blah... you all have a lot of questions on article 370. the biggest questions about that are,

Ø What is Article 370?

Ø When and Why it introduced?

Ø Is It Good or Bad?

Ø Any other unknown things about it?

So, let’s discuss and explore the above questions in detail.

First of all, what is Article 370?

Article 370 is the part of the Indian Constitution that gave special state status to Jammu and Kashmir.

According to this, Jammu and Kashmir have their own. state flagseparate constitution, and autonomy over the internal administration of the state.
In other words, Jammu and Kashmir was an independent state which comes indirectly under India.

So When and Why it introduced?

Boy with big question mark

As we know India becomes independent on 15th August 1947 as well as Jammu and Kashmir also get independence.

At that time Maharaja Hari Singh was the ruler of Jammu and Kashmir, they decided not to merge Jammu and Kashmir in India and keep it a separate state.

But after some days, rebellious forces of Kashmir know as Azad Kashmir Forces in association with Pakistan Forces attacked Kashmir and win some part of Kashmir.

Therefore, to save Jammu and Kashmir from such attacks Maharaja Hari Singh decided to get help from India. So, Maharaja Hari Singh signed the Instrument of Accession on 26th October 1947. The instrument of Accession is the legal document which
made Jammu and Kashmir an indirect part of India.

To supporting that Accession, Article 370 introduced on 17 November 1947 in the Indian Constitution.

Controversies regarding Instrument of Accession:

As we discuss above that Instrument of Accession signed by Maharaja Hari Singh on 26th October. But some claimed that it signed on 27th October.

Also, an Indian Economist and Journalist Prem Shankar Jha argued that Instrument of Accession was actually signed on the 25th of October.

But there is no proof in records. So as per official records, the date was 26th October 1947.

Finally, it is Good or Bad?

Good or Bad

Before stated it was Good or Bad let’s see some interesting facts about Kashmir.

            - Jammu and Kashmir have their own Constitution. Means, all laws passed by State Government except about DefenceForeign Affairs and Communication.

                - The Principle Architect of Indian Constitution Dr. Babasaheb Ambedkar refused to wrote it. So it was by Gopal Swami Ayyangar. The interesting thing is Gopal Swami Ayyangar was former diwan to Maharaja Hari Singh ruler of Jammu and Kashmir.

                  - Kashmir people have two citizenship Jammu and Kashmir and Indian, but Kashmiri woman can’t marry Indian guy!!

                  - Due to more state laws, Kashmiri people’s minds set limited to Kashmir, especially Kashmiri youths. They don’t have a place to explore their passion, creativity, and interest so that’s why they diverted towards terrorism.

So, from the above points I sure you decided your views about Article 370 that it is Good or Bad. Obviously, it is not good for India and Kashmir also.

I hope, I cleared all your doubts about Article 370. If you have any other opinion and question feel free to comment below. Thank you!!!
